2. Service Description

OceanAtlasXII provides a cloud-based customer relationship management (CRM) platform including but not limited to:

  • Contact and lead management
  • Deal pipeline tracking
  • Email and SMS communications
  • Workflow automation
  • Document management and AI analysis
  • Reporting and analytics

Services are provided on a subscription basis. Features available depend on your subscription plan.

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Be authorized to create an account on behalf of your organization
  • Provide accurate and complete information during registration
  • Have a valid email address

4. User Obligations

By using our services, you agree to:

  • Provide truthful, accurate, and complete information
  • Notify us of any changes to your contact information
  • Comply with all applicable federal, state, and local laws
  • Not use our services for any fraudulent or illegal purposes
  • Not interfere with or disrupt our website or services

5. SMS / Text Messaging Terms

By providing your phone number and checking the SMS consent checkbox on any form, you expressly consent to receive text messages from OceanAtlasXII regarding:

  • Application status updates and funding notifications
  • Appointment reminders and confirmations
  • Document requests and account alerts
  • Promotional offers (if opted in)

Message frequency varies based on your application status and account activity. Message and data rates may apply depending on your mobile carrier plan.

Opt-Out: You can cancel SMS messages at any time by texting STOP to our support number. After sending STOP, you will receive a one-time confirmation message, and no further messages will be sent unless you opt in again.

Consent is not required to obtain any goods or services from OceanAtlasXII . Your phone number will not be shared with third parties for their marketing purposes.

6. Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network provider.

7. Data Processing

By using our platform, you authorize OceanAtlasXII to process the data you provide, including contact information, business data, and communications content, for the purpose of delivering our CRM services. You retain ownership of all data you upload to the platform.

8. Service Availability

We strive to maintain high availability of our platform but do not guarantee uninterrupted access. We may perform scheduled maintenance, updates, or experience unforeseen outages. OceanAtlasXII is not liable for any losses resulting from temporary service unavailability.

All content on this website, including text, graphics, logos, and software, is the property of OceanAtlasXII or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

You agree to indemnify and hold harmless OceanAtlasXII , its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

13. Refund and Cancellation Policy

  • Monthly subscriptions: You may cancel at any time. Your access will continue through the end of the current billing period. No partial refunds will be issued.
  • Annual subscriptions: You may cancel at any time. Your access will continue through the end of the annual period. Refund requests made within the first 14 days will be honored in full. After 14 days, no refunds will be issued.
  • Free trials: You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin automatically.
  • Downgrades: Plan downgrades take effect at the start of the next billing cycle.
  • How to cancel: You may cancel your subscription through your account settings or by contacting our support team.

14. Account Termination and Suspension

  • We may suspend or terminate your account if you violate these Terms.
  • We may suspend accounts for non-payment after 30 days past due.
  • Upon termination, your data will be retained for 30 days and then permanently deleted.
  • You may request immediate deletion of your data upon termination.
  • We will provide reasonable notice before suspension, except in cases of fraud or security risk.

15. Dispute Resolution

  • Location: Arbitration will be conducted in New York, NY.
  • Small claims court: Either party may bring claims in small claims court if eligible.
  • Informal resolution: Before filing arbitration, both parties agree to attempt informal resolution by contacting each other for 30 days.

16. Data Processing and AI

  • You grant us a limited license to process your content using third-party AI service providers (including Anthropic and OpenAI) solely to deliver the features of the Service.
  • We do not use your data to train AI models.
  • AI-generated outputs are provided for informational purposes and should be verified before relying on them.
  • You retain all ownership of your data. We claim no ownership over content you upload.

17. Security Practices

  • We implement industry-standard security measures including encryption in transit and at rest, multi-factor authentication, role-based access controls, and immutable audit logging.
  • You are responsible for maintaining the security of your account credentials.
  • We recommend enabling multi-factor authentication (MFA) for all admin accounts.
  • You must notify us immediately of any unauthorized access to your account.

18. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
